The term "The Credit Union" used in this section includes the Credit Union, its directors, officers, and employees. Unless otherwise required by law, in no way is the Credit Union legally liable to you for special, indirect, or consequential damages, including loss of earnings or attorney's fees, even if advised in advance about the possibility of such damages.
The Credit Union does not assume responsibility. It cannot be held responsible for damages or viruses on your electronic equipment or any other property, concerning your access to Coop Online, Your Mobile Account, and Bill Payments or for its use or downloads made of these.
If we do not complete a transfer from or to your account in the stipulated time, or with the appropriate amount, as agreed, we could be liable for damages, as specified by the law for these cases. Suppose the service could not complete any of your payments for any of the reasons listed below. In that case, the Credit Union will not assume responsibility, and you must be responsible for any loss, charge, or penalty that may result:
• If, as long as the Bill Payment service is not at fault, your payment account does not have enough funds to complete the transaction or if the transaction exceeds the credit limit with overdraft line (the payment could be rejected if not enough funds to cover it);
• If the Bill Payment service is not working correctly and you are aware of the failure or the Credit
Union has notified you about it before carrying out the transaction;
• If the money in your account is subject to a legal process or other claims that restrict said transaction;
• If you have not provided the Credit Union with the correct payment account information or the name, address, telephone number, or accurate account information of the recipient, or
• If circumstances beyond the service (including, but not limited to, fires, floods, earthquakes, or other interference from an outside force) impede the transaction's proper execution, and the Credit Union would have taken reasonable precautions to avoid such circumstances.
The list of examples detailed above intends to illustrate cases where we would not be held liable for failure to complete a transfer but does not intend to include all possible circumstances.
